Terms & Conditions

What you can expect from us, what we need from you, and the rules that apply to any work we do together.

Agreement to these terms

These terms govern your use of this website and any services you engage TRINZ Digital Services to provide. By browsing this site, sending an enquiry or accepting a proposal from us, you agree to them.

Where you sign a separate proposal, quotation or service agreement with us, that document takes precedence over these terms for anything it specifically covers.

The services we provide

We provide digital marketing and development services, which may include website design and development, search engine optimisation, social media marketing, content creation, paid advertising, branding, analytics, email marketing, e-commerce and lead generation.

The exact deliverables for your engagement are whatever is written in your accepted proposal. Anything not listed there is out of scope until it is quoted and approved separately.

Quotes, scope and changes

Quotes are based on the requirements shared with us at the time and remain valid for the period stated on the quotation. If requirements change after work begins, we will tell you the impact on cost and timeline before proceeding.

  • Additional pages, features, channels or revision rounds beyond the agreed scope are chargeable.
  • Changes are only carried out after you approve them in writing, including by email or WhatsApp.
  • We never add charges to an invoice that you have not approved in advance.

Payment terms

Payment schedules are set out in your proposal. Project work usually begins after an advance payment, with the balance due at agreed milestones or before final handover. Ongoing services are billed monthly in advance unless stated otherwise.

  • Invoices are payable by the due date shown on them.
  • We may pause work on overdue accounts after giving you notice.
  • All fees are exclusive of applicable taxes, which are charged as required by law.
  • Third-party costs such as domains, hosting, paid tools, stock assets and advertising budgets are separate from our fees.

Advertising budgets and third-party platforms

Advertising budgets are paid by you directly to the platform, such as Google or Meta, and remain under your control. Our fee covers strategy, setup, management and reporting, not the media spend itself.

We are not responsible for platform decisions outside our control, including account suspensions, policy rejections, algorithm changes, pricing changes or service outages. Where such an event affects your campaign, we will tell you promptly and work with you on the response.

What we need from you

Projects move at the pace of the information they depend on. To deliver on time we need:

  • Content, images, product details and approvals within the agreed timeframes.
  • Access to accounts, domains, hosting or platforms required for the work.
  • A single point of contact who can give decisions and feedback.
  • Accurate information about your business, offerings and any claims you want published.

Delays in providing these may extend timelines, and we are not liable for missed deadlines caused by them.

Results and performance

We do not guarantee specific rankings, traffic volumes, lead counts, conversion rates or revenue. No agency can, because search engines and advertising platforms do not sell guaranteed placement and outcomes depend on factors outside our control, including your market, pricing, competition and how quickly enquiries are followed up.

What we commit to is the work described in your proposal, carried out professionally, with honest reporting of what happened.

Ownership and intellectual property

Once all invoices for a project are paid in full, ownership of the final deliverables created specifically for you — including website code, designs, logos and written content — transfers to you.

  • Accounts we create for you, such as advertising, analytics and hosting, are registered in your name wherever the platform allows it.
  • We retain ownership of our own tools, frameworks, internal templates and know-how used to produce the work.
  • Third-party components such as fonts, plugins, stock images and software remain subject to their own licences, which you are responsible for maintaining.
  • Unless you ask us not to, we may reference the work in our portfolio and marketing material.

Confidentiality

Both parties agree to keep confidential any non-public business information shared during the engagement, including strategies, pricing, customer data and account credentials, and to use it only for the purpose of the work.

This obligation continues after the engagement ends. It does not apply to information that is already public, independently developed, or required to be disclosed by law.

Data protection

Our handling of personal information is described in our Privacy Policy. Where we process data belonging to your customers — for example through your analytics, advertising or email accounts — we act on your instructions and only for the agreed work.

You are responsible for ensuring you have the right to share any customer data with us, and for the lawfulness of the marketing you ask us to carry out on your behalf.

Timelines and revisions

Timelines given in a proposal are estimates based on prompt feedback and on the scope agreed at the start. The number of revision rounds included is stated in the proposal; further rounds are chargeable at our standard rates.

Ending an engagement

Either party may end an ongoing engagement by giving the notice period stated in the proposal. If no period is stated, thirty days' written notice applies.

  • Fees for work already completed up to the end date remain payable.
  • Advance payments for work not yet carried out are refundable in line with our Refund Policy.
  • On termination we hand over completed deliverables and remove our access to your accounts.
  • We may end an engagement immediately if we are asked to carry out work that is unlawful, misleading or in breach of platform policies.

Limitation of liability

To the extent permitted by law, our total liability for any claim arising from an engagement is limited to the fees you paid us for the specific service that gave rise to the claim.

We are not liable for indirect or consequential losses, including loss of profit, revenue, data or business opportunity, or for losses caused by events outside our reasonable control.

Use of this website

The content on this website is provided for general information. You may not copy, reproduce or republish substantial parts of it without our permission.

This site may link to third-party websites. We do not control them and are not responsible for their content, accuracy or privacy practices.

Governing law

These terms are governed by the laws of India. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts where our registered office is located.

Before any formal action, both parties agree to attempt to resolve the matter through direct discussion in good faith.

Changes to these terms

We may update these terms as our services or legal obligations change. The date at the top shows when they were last revised. Continued use of this website or our services after an update means you accept the revised terms.
